Terms of Service

Welcome to Recitly (the "Service"), provided by Recitly ("we", "us", "our"). By downloading, accessing or using the Smart AI Flashcard Maker mobile application or recitlycards.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use Recitly. By using the Service you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.

2. Account Registration

• You agree to provide accurate information during registration and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@recitlycards.com of any unauthorized use.

3. Use of the Service

You may use Recitly only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to violate any law or regulation.
• Reverse engineer, decompile or attempt to extract source code.
• Submit content that infringes intellectual property rights of others.
• Submit content that is illegal, hateful, harassing, sexually explicit, or harmful to minors.
• Use the AI features to generate content that violates our policies or applicable laws.
• Interfere with or disrupt the integrity of our backend, networks or other users' use.
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission.
• Resell, sublicense or redistribute the Service.

4. AI Features & User Content

Recitly uses third-party AI (Anthropic Claude) to generate flashcards from your inputs. You acknowledge that:

• AI-generated content may be inaccurate or incomplete. Verify important information independently.
• You retain ownership of the inputs you submit and the flashcards generated for you.
• You grant us a worldwide, non-exclusive, royalty-free license to process your inputs solely to provide the Service.
• We may use anonymized, aggregated usage data to improve the Service.
• You are solely responsible for the content you submit. Do not submit confidential, sensitive or proprietary information that you are not authorized to share.

5. Subscriptions & In-App Purchases

Recitly offers free tier and optional paid subscriptions ("Premium") via in-app purchases:

• Subscription pricing and billing periods are shown clearly on the in-app paywall before purchase.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• You can cancel anytime through your Apple ID account settings (iOS) or Google Play Store subscriptions (Android). Uninstalling the app does not cancel a subscription.
• If a free trial is offered: any unused portion of the free trial will be forfeited if you start a paid subscription.
• Refunds are handled according to Apple's and Google's refund policies.
• You can restore previous purchases at Settings → Restore Purchases.

6. Intellectual Property

The Service, including software, design, branding, text and graphics (excluding User Content), is owned by Recitly and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

7. Third-Party Services

Recitly integrates with third-party services including Anthropic (AI processing), Apple App Store / Google Play (distribution and payments) and cloud infrastructure providers. Your use of these services is subject to their respective terms.

8. Termination

You may delete your account at any time from Settings → Account → Delete Account or at recitlycards.com/delete-account. We may suspend or terminate your access to the Service at our discretion if you violate these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that AI-generated content is accurate, complete or suitable for any specific purpose. Recitly is an educational aid — verify important facts independently.

10. Limitation of Liability

To the maximum extent permitted by law, Recitly shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, use or goodwill arising out of or in connection with your use of the Service. In no event shall our total liability exceed the amount you have paid to us in the 12 months preceding the claim, or USD 50 if you are a free-tier user.

11. Indemnification

You agree to indemnify and hold harmless Recitly, its officers and employees from any claims arising from: (a) your use of the Service in violation of these Terms; (b) your User Content; (c) your violation of any law or third-party rights.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated through the App or by email. Continued use after changes means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of Ukraine, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Ukraine, except where local consumer law grants you mandatory rights to other forums.
